Berubari. Berubari Case, 1960 was regarding the power of the Parliament to transfer the territory of Berubari to Pakistan. In this case Supreme Court ruled that the Preamble is not a part of the Constitution and not amendable under Article 368 (Power of Parliament to amend the Constitution) of the Constitution. Later in Kesavananda Bharati case, 1973, the Supreme Court ruled that the Preamble is the part of the Constitution. In the Bommai Vs.Union of India case, 1994, the Supreme Court ruled that the Preamble is part of the Constitution and can be amended according to Article 368 of the Constitution but the amendment is subject to certain conditions such as it cannot alter the ‘Basic Structure’ of the Constitution.
