The Government of India Act 1935. The Government of India Act, 1935 introduced federal system at the Centre. It abolished India Council. Residually subject was given to Viceroy not to the Provincial legislature. Its salient features are as follows: (i) The India Act, 1935 proposed to set up All Indian Federation, comprising of the British Indian Provinces and Princely States. The States were absolutely free to join or not to join the proposed Federation. (ii) Diarchy was abolished in the provinces. Proper division of subjects between the Centre and the Provinces under 1919 Act was revised and the 1935 Act contained three lists namely Federal (Center), Provincial and Concurrent (both for Center and Province) legislative lists. The Viceroy was vested with residual powers which were to be exercised by him through Governor General. (iii) The India Act, 1935 introduced Diarchy at the Centre. The Federal Subjects were divided into two categories namely ‘reserved’ and ‘transferred’. However, it did not came into operation at all. (iv) A very significant provision of the 1935 Act was the safeguards and protective armours for the minorities. The Anglo-Indians and the Indo- Christians were also given separate electorate. (v) The Government of India Act, 1935 provided for the establishment of a Federal Court. (vi) The supremacy of the British Parliament remained intact under the Government of India Act, 1935. The Government of India Act, 1935 abolished the Council of the Secretary of State for India, which was created in 1858. (vii)Burma was separated from India with effect from April 1937. The 1935 Act provided for the creation of two new provinces of Sindh and Orissa.
